Customer rights
Electronic acceptance of this agreement authorises the user, with the exception of restriction by Club-DVD, to rent DVD movies from Club-DVD. User's company must have come to an agreement with Club-DVD to authorise its employees to rent DVD movies from Club-DVD. At any time, the users' company can cancel this agreement, as Club-DVD can also at any time stop to deliver this service to the users' company. In both cases Club-DVD is free to not reimburse the users immediately, but to propose them a sufficient period of time to spend their credit amount in renting or purchasing DVDs. On member's request, the reimbursement of his account's credit can be done only if the employee leaves definitely his company or if he is transferred to another place. If the member wishes to cancel his subscription, Club-DVD is not obliged to reimburse his account's credit, but the member can use his credit for buying or renting DVD movies at his own convenience.
Rates
For rentings :
CHF 7.00 for 1 DVD per week-end
CHF 6.00 per DVD for 2 DVDs per week-end
CHF 5.00 per DVD for 3 DVDs per week-end
(TVA included)
For each additional week-end, Club-DVD will charge automatically the rate of the previous week-end
DVD for sale :
Between CHF 3.- & CHF 5.- per DVD (incl. VAT)
At any time Club-DVD may change the rental rates & conditions.
User's Obligations
User is comitted himself to keep safely in his possession all DVD movies rented from Club-DVD.
User agrees not :
* To sell, rent, lend, exchange all DVD movies rented from Club-DVD
* To unstick, mask, change property labels and code bars on the DVD box
* To present the rented movie outside the family
* To copy or reproduce, even partially, any content of the rented DVD
Any violation of the above clauses will involve the cancellation of the membership agreement and without advance notice.
Copyright
All content included on this site, such as text, graphics, logos, buttons, icons, images, videos and software, is the property of Club-DVD.ch or its content suppliers, and protected by swiss and international copyright laws. All software used on this site is the property of Club-DVD.ch and its software is protected by swiss and international copyright laws. Any use, including the reproduction, modification, distribution, transmission, republication, display or performance, of the content on this site is strictly prohibited.
Property
All movies rented from Club-DVD remain Club-DVD's exclusive property.
Stolen, lost or damaged DVD
User is responsible for stolen, lost or damaged DVD movie. CHF 100.- will be charged to user for each lost or stolen DVD movie. User must inform immediately Club-DVD about loss or theft. User will be charged for the rental period until his notification to Club-DVD. DVD support is highly sensitive, therefore its condition status will be always stated on its box (perfect, medium or acceptable). User must return the DVD movie in same condition.
Privacy
Club-DVD is committed to protecting your privacy. We will not share, trade, sell, or in any way divulge your personal information (including your purchase/rental history) to any outside parties, in strict accordance with swiss law and your company's guidelines. We only use your information to process orders and to provide a more personalized shopping experience.
Delay or non-delivery
Club-DVD can't be held responsible for any delay or a non delivery due to a computer system failure.
Computer system failure
Club-DVD can't be held responsible for: server or website outage, loss of data, violation of its data by hackers or a third party.
Illicit use
Club-DVD can't be held responsible for non-members (like minors) using illegaly user ID and password. User is responsible for maintaining the confidentiality of his ID and password. User is responsible for all uses of his account.
Damage
Club-DVD can't be held responsible for any damage caused by any products rented or purchased from
Club-DVD.
Law to be applied
These conditions are ruled by swiss law. Any disputes arising out of or related to Club-DVD's Service and its web site shall be governed by, and construed and enforced in accordance with, the laws of Geneva Court.
